This Agreement represents the entire agreement and understanding between Tarisu Limited and the Customer, superseding all prior written or oral agreements. Tarisu Limited may modify, expand, and/or change these terms and conditions, alter prices, or discontinue or modify services by posting a notice on the Website.
By placing information on Tarisu Limited’s servers under the terms of this Agreement, you confirm that you have read and understood this Agreement and agree to be bound by its terms and conditions. If you do not agree to be bound by these terms and conditions, you should not place any information on Tarisu Limited’s servers.
1. USER CONDUCT
The services provided by Tarisu Limited may only be used for lawful purposes. Any use of these services that violates any local, state, or international law, or any law that may apply to your jurisdiction, or any jurisdiction to which you or your site may be subject, is strictly prohibited. When using the service, you may not:
- A. Restrict or inhibit any other user from using the Internet;
- B. Post or transmit any unlawful, threatening, abusive, defamatory, harassing, obscene, offensive, or otherwise objectionable information of any kind, including, without limitation, any transmission that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law, including, but not limited to, laws protecting intellectual property, copyright, trademark, trade secret, misuse, and dilution laws and regulations;
- C. Post, publish, transmit, reproduce, or distribute any information or software that contains a virus or other harmful component; publish, broadcast, transmit, reproduce, distribute, or exploit in any way any information, software, or other material obtained through the service for commercial purposes (except where expressly permitted by the provider of such information, software, or other material);
- D. Send unsolicited emails (spam), use open proxies, P2P, torrent servers, Internet Relay Chat (IRC) bots/clients/servers/bouncers. Flooding, cloning, impersonating, harassing, or otherwise disrupting the ability of IRC to be properly used is prohibited. Impersonating others, advertising, and sending spam through IRC is prohibited. IRC services used as command and control channels for bots are prohibited;
- E. Use the servers for up/down services. Any account found engaging in such activity will have the service canceled immediately;
- F. Use web hosting services to store high-volume media or video files. Hosting services are intended solely for web content, and storing large media files or video libraries is prohibited.
2. INDEMNITY
You agree to indemnify, defend, and hold harmless Tarisu Limited from any and all liabilities, penalties, losses, damages, costs, expenses, attorney fees, causes of action, or claims arising out of or resulting from your use of the services, regardless of any negligence on the part of Tarisu Limited, or any third party or parties. This indemnification and hold harmless agreement extends to all issues associated with your account, including, but not limited to, domain name selection and website content.
3. REFUSAL OR TERMINATION OF SERVICE
Tarisu Limited reserves the right to refuse or terminate service to anyone at its sole discretion. If you engage in any activity or behavior that Tarisu Limited, in its sole discretion, believes violates any of the terms and conditions in this Agreement, it may deny you access to all or part of the service without notice. Tarisu Limited shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor shall it be responsible for any consequences resulting from such a termination or lack of notification.
4. NO WARRANTY
Tarisu Limited makes no warranties or representations of any kind for the services being offered. The service is provided "as is" and "as available" without any warranty of any kind, either express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. No advice or information given by Tarisu Limited or its representatives or employees shall create a warranty. Tarisu Limited does not warrant that the service will be uninterrupted or error-free or that any information, software, or other material accessible through the service is free from viruses or other harmful components. Under no circumstances shall Tarisu Limited be liable for any direct, indirect, special, punitive, or consequential damages that result from the use of, or the inability to use, the service, or that result from reliance on or use of information, services, or goods obtained on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with Tarisu Limited service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.
5. INFORMATION RESTRICTIONS
By placing information on Tarisu Limited’s servers, you acknowledge that this information becomes accessible to all users of the Internet, and Tarisu Limited has no means of limiting or restricting access to such information or protecting it from copyright infringement. You assume all responsibility and risk associated with the use of Tarisu Limited’s servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, and other information, and the quality and merchantability of all merchandise provided through the service or on the Internet generally.
6. IDENTIFICATION INFORMATION
You acknowledge that you are at least 18 years of age and legally responsible for the use of this account. You agree to provide Tarisu Limited with accurate and up-to-date identification information, including a name, postal address, and telephone number for our records, and to maintain the accuracy of this information. You also acknowledge that you are an authorized user of any credit card you provide to Tarisu Limited and that Tarisu Limited has the right to fully investigate any potential fraudulent credit card use.
7. NO INTERFERENCE WITH SYSTEM OPERATION
You agree not to maliciously or intentionally interfere with the proper operation of the system, including, but not limited to, gaining unauthorized access beyond what you are authorized to access, and interfering with the availability, reliability, or quality of the service for other customers. You also agree not to interfere with the proper operation of other systems accessible via the Internet, including any attempt at unauthorized access. You agree to follow the Acceptable Use Policy of any network or service you connect to. You agree to adhere to system policies as published online by Tarisu Limited, including restrictions on services available with each account type, restrictions on certain features, and all other policies designed to protect and enhance the quality and reliability of service at Tarisu Limited. You agree to abide by any future policy decisions of Tarisu Limited.
8. SECURITY
You acknowledge that you are solely responsible for the security of your account. You also agree that if you believe your account has been compromised in any way, you will notify Tarisu Limited immediately via email at [email protected]. You are fully responsible for any misuse or compromise of your account that Tarisu Limited is not properly notified about. You agree not to share or provide access to your account to any third party and acknowledge that you are responsible for any use of your account by any party to whom such access has been provided. You agree that certain features of your account (e.g., FrontPage webs, additional FTP logins) that may allow shared access to your account shall not be used to sell services to third parties, and you accept responsibility for any actions of any party using such features. You acknowledge that Tarisu Limited reserves the right to suspend access to your account pending an investigation and resolution if a security breach is suspected. You further acknowledge that Tarisu Limited has the right to cooperate in any government or legal investigation regarding any aspect of our services, including services sold to you.
9. DATA BACKUPS
Your use of the service is solely at your own risk. Tarisu Limited is not responsible for any files and data residing on your account. You agree to maintain all appropriate backups of files and data stored on Tarisu Limited servers and assume all responsibility for those backups unless you subscribe to any additional backup services provided by Tarisu Limited.
10. MATERIAL TRANSMISSIONS
You agree not to transmit any unsolicited or prohibited advertisements or other harassing or illegal materials through email, Usenet postings, or other Internet media. Any reference to any services obtained through Tarisu Limited or provided by Tarisu Limited used in connection with unsolicited bulk emails, postings, or other activities considered "spamming" is strictly prohibited and may result in immediate termination of your services without warning, and you will be held fully responsible for any damages incurred by Tarisu Limited or any other party as a result of such activities.
11. PAYMENT AND DELIVERY
You agree to make appropriate payments for the services rendered by Tarisu Limited before the time period during which such services are provided. You agree that all setup fees are non-refundable once the setup is completed. You agree that all services will be regularly billed unless you notify Tarisu Limited of your wish to cancel any or all services. If you are paying by credit card, you agree that Tarisu Limited may apply the amount due at any time to the card provided.
Refunds will only be issued before the product or service is delivered. No refunds will be issued once the product or service has been delivered. There will be no refunds for physical servers under any circumstances. Tarisu Limited does not accept any refund or return requests once the delivery has been made. Our refund policy does not include add-on services such as Domain Registration, Domain Transfer, software license fees (cPanel, DirectAdmin, Fantastico, Softaculous, Litespeed, RvSkin, etc.), Domain Privacy, or dedicated IP, server management, SSL, credit card processing fees, and setup fees.
If any illegal activity occurs with a service, the account will be banned without a refund.
All services are delivered on the same day once the account and payment verification against fraud is completed. In some cases, service preparation and/or hardware customization may take 1 to 7 days. The service delivery time depends on service availability. If a service is not available, we will make a refund for that service within 3 business days. Any server upgrades or additional software installation will be completed within 2 to 4 days.
12. TERMINATION
This Agreement may be terminated at any time by either party upon written notice of termination. You are responsible for notifying Tarisu Limited of your desire to terminate this Agreement. Tarisu Limited reserves the right to suspend your service at any time, for any reason, without notice, refund, or liability.
13. LAW AND JURISDICTION
This Agreement is governed by the laws of the country in which the server is hosted and also by the laws of the United Kingdom. Any disputes arising under or in connection with this Agreement shall be resolved through the courts of the server’s host country and the courts of England and Wales.
14. SERVICE USAGE AND LIMITATIONS
The server services provided by Tarisu Limited may only be used for web content hosting purposes and are strictly prohibited from being used for up/down (upload/download) services. Such services can create excessive load on Tarisu Limited's resources and negatively affect service quality. Moreover, long-term and continuous high bandwidth usage is prohibited. If a customer engages in such activities, Tarisu Limited reserves the right to suspend the service without prior notice and may even terminate the service entirely. In such cases, the customer will not be entitled to any refund. Tarisu Limited also reserves the right to impose further restrictions related to service usage at its sole discretion.
